Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Dashible, Inc., a Delaware corporation (“Dashible,” “we,” “us,” or “our”), the operator of The NYC Plug, including the website at nycplug.net, our mobile applications, and any related features and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility & age requirement

The Service is intended only for adults who are 21 years of age or older. By using the Service, you represent and warrant that you are at least 21, that you have the legal capacity to enter into these Terms, and that your use complies with all laws applicable to you. We may require you to confirm your age and may deny access to anyone who cannot or does not.

2. What the Service is, and is not

The NYC Plug is an informational directory of licensed cannabis dispensaries. We aggregate publicly available licensing information and other data and let users browse, review, and contribute information about dispensaries, along with related features such as deals and events information, mini-games, and loyalty punch cards. We are an independent service and are not affiliated with, endorsed by, or sponsored by any government agency, dispensary, or brand listed on the Service.

The Service does not sell, broker, deliver, or facilitate the sale of cannabis or any product, and no transaction for cannabis occurs through the Service. Any purchase you make occurs solely between you and a licensed dispensary, subject to that dispensary’s terms and applicable law.

3. No professional advice

Content on the Service is provided for general informational purposes only and is not legal, medical, financial, or professional advice. Cannabis laws and regulations change frequently and vary by jurisdiction. Always verify current rules with official sources and consult a qualified professional before acting. We make no representation that any listing, hours, license status, deal, event, or other information is accurate, complete, or current.

4. Cannabis & legal compliance

Cannabis remains illegal under U.S. federal law, and state and local laws differ. You are solely responsible for understanding and complying with all laws that apply to you. Nothing on the Service should be construed as encouragement to violate any law.

5. Accounts

Some features require an account. You may sign in using a password, a one-time email link (“magic link”), or other methods we offer. You agree to provide accurate information, to keep your account secure, and to be responsible for activity under your account. You may not share, sell, or transfer your account. We may suspend or terminate accounts that violate these Terms. You may request deletion of your account at any time by emailing [email protected].

6. User content

The Service lets you submit reviews, ratings, photos, comments, and other materials (“User Content”). You retain ownership of your User Content. By submitting it, you grant Dashible a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, modify (for formatting), display, distribute, and otherwise use your User Content to operate, promote, and improve the Service.

You represent and warrant that, for any User Content you submit:

• you own it or have all rights necessary to grant the license above;
• it is accurate and reflects your genuine experience or opinion;
• it does not infringe any third party’s rights or violate any law; and
• it is not unlawful, defamatory, harassing, hateful, sexually explicit, deceptive, spam, or otherwise objectionable.

We may, but are not obligated to, review, screen, moderate, edit, refuse, or remove User Content at our discretion, including using automated tools. Content awaiting review may be displayed in an obscured form or withheld. We are not responsible for User Content, which reflects the views of the person who submitted it, not Dashible.

7. Dispensary listings & profile claiming

Listings are compiled from official licensing directories and other sources and may contain errors or be out of date. A dispensary owner or authorized representative may claim a listing by verifying control of an email address on the business’s website domain and subject to our approval. If you claim a listing, you represent that you are authorized to act for that business and that the information you provide is accurate. We may revoke a claim at any time. 8. Mini-games & scores

The Service includes casual mini-games. The games are for entertainment only. They are not a sobriety, impairment, fitness, medical, or safety test of any kind, and no score, baseline, comparison, or message in the games may be relied on as an indication that you are able to drive, operate machinery, work, or do anything else. Never drive after using cannabis.

Game scores and related statistics are stored on your device and, if you are signed in, synced to your account. Scores have no monetary value, cannot be redeemed for anything, and involve no wagering or prizes. We may adjust scoring formulas, reset scores or baselines, or modify or remove games at any time.

9. Loyalty punch cards

Where offered, digital punch cards let participating dispensaries reward repeat visits. Punches and rewards have no cash value, are not transferable, and may expire or change as described in the applicable offer. Rewards are offered and fulfilled by the participating dispensary, not by Dashible, and are subject to that dispensary’s terms and applicable law. We may void punches or rewards we reasonably believe were obtained fraudulently and may modify or discontinue the program at any time.

10. AI features

Parts of the Service use artificial intelligence, for example chat assistants that answer questions about a dispensary and automated judging in word games. AI outputs are generated automatically, may be inaccurate, incomplete, or unsuitable, and are not advice of any kind. AI chat assistants are not a substitute for confirming details (such as hours, availability, or prices) directly with a dispensary. Do not submit sensitive personal information to chat or game inputs.

11. Subscriptions & billing

Certain business-facing features (such as “The Plug Plus” for dispensary owners) are offered as paid subscriptions billed through our payment processor (Stripe). By subscribing, you authorize recurring charges at the stated price and interval until you cancel. You can cancel at any time, effective at the end of the current billing period. Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial billing periods; we may consider refund requests case by case at [email protected]. If a price changes, we will give notice before the change applies to you. Taxes may apply.

12. Acceptable use

You agree not to:

• use the Service for any unlawful purpose or in violation of these Terms;
• scrape, harvest, or bulk-download data except as expressly permitted;
• interfere with or disrupt the Service, or attempt to gain unauthorized access to any account, system, or data;
• impersonate any person or misrepresent your affiliation;
• post false, misleading, or manipulated reviews, or solicit or pay for the same;
• manipulate game scores, loyalty punches, or other Service features;
• upload malware or attempt to circumvent age, security, or moderation controls.

13. Intellectual property

The Service, including its software, design, text, graphics, logos, games, and compilation of content (excluding User Content and third-party materials), is owned by Dashible or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use (or, for claimed dispensary accounts, your internal business use). “The NYC Plug,” “Dashible,” and related logos are our trademarks; you may not use them without permission.

14. Copyright complaints

If you believe content on the Service infringes your copyright, send a notice to [email protected] with: (a) identification of the work and of the allegedly infringing material (including its URL); (b) your contact information; (c) a statement that you have a good-faith belief the use is not authorized; (d) a statement, under penalty of perjury, that the notice is accurate and you are the owner or authorized to act for the owner; and (e) your physical or electronic signature. We may remove content and may terminate repeat infringers’ accounts.

15. Third-party services & links

The Service uses and links to third-party services and websites (for example, mapping and directions providers, payment processing, and official government resources). We do not control and are not responsible for third-party content, products, or practices. Your use of third-party services is governed by their terms and policies.

16. Disclaimers

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY INFORMATION (INCLUDING LISTINGS, HOURS, LICENSE STATUS, DEALS, EVENTS, AI OUTPUTS, OR GAME RESULTS) IS ACCURATE OR CURRENT.

17. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DASHIBLE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE AND (B) ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

18. Indemnification

You agree to indemnify and hold harmless Dashible and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your User Content, your use of the Service, or your violation of these Terms or any law or third-party right.

19. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including a violation of these Terms. You may stop using the Service, and may request account deletion, at any time. Provisions that by their nature should survive termination will survive.

20. Changes to the Service or Terms

We may modify the Service or these Terms at any time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use after changes take effect constitutes acceptance.

21. Governing law & disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Before filing a claim, you agree to first contact us at [email protected] and give us 30 days to try to resolve the dispute informally.

Any dispute not resolved informally will be resolved by binding arbitration on an individual basis, administered by a recognized arbitration provider under its consumer rules, except that either party may (a) bring an individual claim in small-claims court or (b) seek injunctive or other equitable relief in court for infringement or misuse of intellectual property or unauthorized access to the Service. You and Dashible each waive the right to a jury trial and to participate in a class action, class arbitration, or other representative proceeding. If the class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court. To the extent court proceedings are permitted, they shall take place in the state or federal courts located in Delaware or, for small-claims matters, in your county of residence.

22. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them freely. These Terms, together with the Privacy Policy, are the entire agreement between you and Dashible regarding the Service.
